Service Agreement

This service agreement ("Contract", "Terms") establishes the relationship between Home Peck FZC LLC ("Home Peck", "Company", "we" or "us") and you ("Customer", "you" or "your"). This Contract governs your access to and utilization of the www.homepeck.com platform and all related offerings (collectively, "Platform" or "Services").

Customer Requirements and Basic Rules

Customers must have reached the age of majority (18 years) and possess legal capacity to enter financial commitments to utilize our Platform. By browsing our site or completing transactions, you acknowledge acceptance of these Contract provisions. Should you disagree with any stipulations, platform access and service usage are prohibited. The United Arab Emirates serves as our legal domicile with local regulations governing this relationship.

Transaction Processing and Financial Terms

Our platform supports multiple transaction methods including Visa, MasterCard payment cards in AED currency, cash collection upon delivery, Apple Pay processing, and flexible payment plans (Tabby / Tamara) if/when offered. Financial processing occurs immediately upon purchase confirmation. We maintain discretionary authority to reject transactions, modify pricing structures without advance notice, or restrict purchase volumes. When order modifications or cancellations occur, customer notification attempts will be made through provided contact information. All transaction data must be current, accurate, and complete. All of our products are priced in UAE Dirhams ; foreign currency transactions utilize your financial institution's conversion rates.

Platform Content and Inventory Management

Our Contract provisions may undergo periodic revisions, and customers bear responsibility for monitoring such updates. Transaction completion signifies agreement with the most current published Contract terms. We retain authority to modify these provisions through platform announcements, with continued usage indicating acceptance of revisions.

Product specifications, costs, and stock levels displayed may contain inaccuracies or oversights. We reserve discretionary power to cancel any order, rectify mistakes and update information without prior customer notification, including post-transaction corrections. Visual representations may differ from actual product appearance due to display variations. We maintain authority to limit purchase quantities, cancel orders.

External Resources and User-Generated Content

Our platform may reference external websites or provide access to third-party applications. We disclaim responsibility for and provide no endorsement of external content, merchandise, or services. Third-party platform usage occurs at customer risk under their respective terms.

Customer submissions of feedback, suggestions, or other materials grant us unrestricted usage rights without compensation obligations or confidentiality requirements. Customers must ensure submissions comply with applicable regulations and respect third-party rights.

Prohibited Activities

Platform usage for illegal activities, regulatory violations, intellectual property infringement, harassment or discrimination, false information submission, malicious code distribution, or security system interference is strictly forbidden. We maintain termination rights for any prohibited conduct.

Ownership and Intellectual Assets

All platform content, branding elements, and materials remain our exclusive property or that of our licensors. Platform usage grants no intellectual property rights to customers.

Service Disclaimers and Risk Allocation

Our platform and services operate on an "as-is" basis without performance guarantees. We disclaim warranties regarding merchantability, suitability for specific purposes, and non-infringement. No assurance exists regarding uninterrupted, secure, or error-free operations.

Company Liability Limitation:

Home Peck expressly excludes responsibility for special, incidental, or consequential losses including property damage, equipment loss, personal harm, or related costs connected to our product sales or usage. Our maximum financial responsibility remains capped at the defective merchandise purchase amount.

Total company liability for any claims cannot exceed amounts paid to us during the purchase.

Customer Indemnity Obligations

Customers agree to protect Home Peck from claims, losses, or expenses resulting from platform misuse or Contract violations.

Final Provisions

Unenforceable Contract provisions will not invalidate remaining terms. UAE law governs this agreement with local courts maintaining exclusive jurisdiction. We may update these terms through platform postings, with continued usage demonstrating acceptance of modifications.
