1. About These Terms

These Terms of Service ("Terms") govern your access to and use of www.homepeck.com and all related services (the "Platform"). The Platform is operated by Homepeck FZE LLC, registered in the United Arab Emirates (Licence No. 4416492), trading as The Home Peck ("we", "us", "our").

By browsing the Platform or placing an order, you agree to these Terms. If you do not accept them, please do not use the Platform.

Our Privacy Policy, Shipping & Delivery Policy and Refunds, Return and Exchange Policy form part of these Terms.

2. Eligibility

You must be at least 18 years of age and have the legal capacity to enter into binding contracts in order to purchase from the Platform. By placing an order, you confirm that you meet these requirements and that the information you provide is accurate, current and complete.

3. Orders and Acceptance

Your order is an offer to purchase. A contract is formed only once we confirm acceptance of your order.

We reserve the right to decline or cancel any order, including after confirmation, in circumstances such as suspected fraud, pricing or listing errors, or unavailability of stock. Where we cancel an order, we will notify you using the contact details you provided and refund any amount already charged.

We may also limit purchase quantities on any product.

4. Pricing and Payment

All prices are displayed in UAE Dirhams (AED). Where a foreign currency is used, conversion is applied by your financial institution at their prevailing rate.

We accept:

• Visa and MasterCard
• Apple Pay
• Cash on delivery
• Instalment payments through Tabby and Tamara

Payment is processed at the point of purchase. Instalment plans are provided by Tabby and Tamara under their own terms, and any dispute relating to an instalment plan is governed by the agreement between you and that provider.

Prices may change at any time without prior notice. Changes do not affect orders already accepted.

5. Product Information and Availability

We take care to describe our products accurately, but listings may occasionally contain errors or omissions in specifications, pricing or availability. We reserve the right to correct such errors and to cancel affected orders, including after a transaction has been completed.

Product images are provided for illustration. Colour, finish and texture may vary from what appears on your screen, and natural materials such as marble, travertine and wood vary between pieces by nature. Such variation is a characteristic of the material rather than a defect.

6. Delivery, Returns and Cancellations

Delivery timeframes, return eligibility and cancellation requests are governed by our Shipping & Delivery Policy and our Refunds, Return and Exchange Policy.

Made-to-order products — including marble and natural stone furniture, sofas, poufs and fabric items — are produced specifically for you and are not eligible for return, refund or exchange other than in cases of damage or defect.

7. Third-Party Links and Services

The Platform may link to or integrate with third-party websites, applications or payment providers. We do not control and are not responsible for their content, products, services or practices. Your use of any third-party service is at your own risk and subject to that provider's terms.

8. Your Content and Communications

If you send us feedback, suggestions, reviews or other materials, you grant us a non-exclusive, royalty-free right to use them without compensation or obligation of confidentiality. You confirm that any material you submit is lawful and does not infringe the rights of others.

9. Acceptable Use

You may not use the Platform to:

• Carry out any unlawful activity or breach any applicable regulation
• Infringe our intellectual property rights or those of any third party
• Harass, abuse, defame or discriminate against any person
• Submit false, misleading or fraudulent information
• Introduce malicious code or interfere with the security or operation of the Platform

We may suspend or terminate access for any breach of this section.

10. Intellectual Property

All content on the Platform — including text, product photography, graphics, layout, and the names "The Home Peck" and "Homepeck" — is owned by us or our licensors and protected by applicable law. Use of the Platform does not grant you any rights in that content.

11. Disclaimers

The Platform and its services are provided on an "as-is" and "as-available" basis. To the fullest extent permitted by law, we make no warranties of any kind, express or implied, including as to merchantability, fitness for a particular purpose, or non-infringement. We do not warrant that the Platform will be uninterrupted, secure or free from error.

Nothing in these Terms excludes or limits any rights you have under the consumer protection laws of the United Arab Emirates.

12. Limitation of Liability

To the fullest extent permitted by law, The Home Peck shall not be liable for any indirect, incidental, special or consequential loss, including property damage, loss of use, or personal injury, arising from the sale or use of our products.

Our total liability in respect of any claim shall not exceed the amount you paid for the product giving rise to that claim.

13. Indemnity

You agree to indemnify and hold harmless Homepeck FZE LLC, its officers and employees, against any claims, losses, liabilities or expenses arising from your misuse of the Platform or breach of these Terms.

14. Changes to These Terms

We may update these Terms from time to time. Changes take effect when posted on the Platform, and your continued use constitutes acceptance. Please review this page periodically.

15. Governing Law

These Terms are governed by the laws of the United Arab Emirates. The courts of the UAE have exclusive jurisdiction over any dispute arising from them.

16. Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions continue in full force.
